Welcome to Vapr Vapes. These Terms and Conditions ("Terms") govern your access to and use of vaprvapes.com and your purchase of nicotine products, including e-cigarettes, vaping devices, e-liquids, and nicotine pouches (collectively, "Products"). By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Age Restriction — 19+ Only

1.1 You must be at least 19 years of age to purchase or use the Products sold on this Site.

1.2 By placing an order, you represent and warrant that you are at least 19 years old and legally permitted to purchase nicotine products in your jurisdiction.

1.3 We use third-party age and identity verification at checkout. We reserve the right to refuse or cancel any order where age cannot be verified, and to require valid government-issued photo ID upon delivery.

1.4 Our courier partners require an adult signature (ID checked) on delivery of all Products. Orders left unclaimed after a failed ID check will not be redelivered without re-verification.

2. Health and Safety Warnings

2.1 Nicotine is an addictive chemical. Products sold on this Site contain nicotine, a highly addictive substance.

2.2 Nicotine products are not intended for use by non-smokers, youth, pregnant or breastfeeding individuals, or persons with heart conditions, and should not be used by anyone.

2.3 Keep all Products, including e-liquids and nicotine pouches, out of reach of children and pets. Nicotine in any form is toxic if ingested, and e-liquid is toxic if absorbed through the skin.

2.4 Products are sold for use by adult smokers/nicotine users only and are not smoking cessation devices unless expressly approved as such by Health Canada.

3. Geographic and Legal Restrictions

3.1 We currently ship only within Canada, and only to addresses where receipt of these Products is legal.

3.2 It is your responsibility to know and comply with the laws of your jurisdiction. We are not responsible for orders that violate local, provincial, or federal law upon delivery.

3.3 Certain Products (including flavoured vaping products and nicotine pouches) are subject to specific provincial and federal sales restrictions that change from time to time, including restrictions on flavour, packaging, nicotine concentration, and permitted points of sale. We reserve the right to modify product availability at any time to remain compliant with Health Canada and Ontario regulations.

4. Product Information and Compliance

4.1 All Products comply with applicable requirements of the Tobacco and Vaping Products Act (Canada) and the Smoke-Free Ontario Act, 2017 at the time of listing.

4.2 Nicotine concentration, ingredients, and health warning labelling are as required by Health Canada. Product images are for illustration only; packaging and labelling may vary.

4.3 We do not make any health claims about these Products, including claims that they are safe, safer than smoking, or effective for smoking cessation, except where expressly authorized by Health Canada.

5. Advertising and Marketing Compliance

5.1 In accordance with restrictions on vaping product promotion, product descriptions on this Site are limited to factual information (brand, flavour, nicotine strength, price) and do not include lifestyle imagery, testimonials, or promotional claims prohibited under applicable law.

5.2 We do not knowingly market or advertise these Products to persons under 19, and we do not permit sponsorship, contests, or promotions that could appeal to minors.

6. Orders, Pricing, and Payment

6.1 All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes (HST) at checkout.

6.2 We reserve the right to refuse, limit, or cancel any order, including for suspected resale, suspected purchase by a minor, or suspected fraud.

6.3 Order confirmation does not guarantee product availability. If a Product becomes unavailable after your order is placed, we will notify you and issue a refund for that item.

7. Shipping and Delivery

7.1 Orders require an in-person signature from a person 19 years of age or older, with photo ID checked by the courier at the time of delivery.

7.2 We are not liable for delays caused by ID verification failures, courier issues, or circumstances beyond our control.

7.3 Risk of loss and title to Products pass to you upon delivery.

8. Returns and Refunds

8.1 Due to health and safety regulations, opened e-liquid, opened nicotine pouch containers, and used devices cannot be returned or refunded, except where defective.

8.2 Unopened, unused Products in original packaging may be returned within [X] days of delivery for a refund, less shipping costs, subject to inspection.

8.3 Defective devices are covered by the manufacturer's warranty, where applicable; contact us at [support email] to initiate a warranty claim.

9. Prohibited Use

9.1 You may not purchase Products on this Site for resale, redistribution to minors, or export to jurisdictions where such Products are prohibited.

9.2 You may not use the Site for any unlawful purpose or to misrepresent your age or identity.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, Vapr Vapes is not liable for any indirect, incidental, special, or consequential damages arising from the use or misuse of the Products.

10.2 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under Ontario law, including the Consumer Protection Act, 2002.

11. Intellectual Property

11.1 All content on the Site, including logos, text, and images, is owned by or licensed to Vapr Vapes and may not be reproduced without permission.

12. Privacy

12.1 Our collection and use of your personal information, including age-verification data, is governed by our Privacy Policy, in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

13. Governing Law

13.1 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13.2 Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to These Terms

14.1 We may update these Terms at any time to reflect changes in law or our business practices. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
